Gregory J. Pepe Joins the Executive Board of ASMAC
June 13, 2019NEW HAVEN, Connecticut (June 13, 2019) – Gregory J. Pepe, founding principal with the firm of Neubert, Pepe & Monteith, P.C. has been nominated as Treasurer of the American Society of Medical Association Counsel (“ASMAC”).
Attorney Pepe states, “I am very happy to serve in a leadership role of an organization comprised of my professional peers all working for state and national organized medicine entities, such as the AMA, the Connecticut State Medical Society, and others.”
At ASMAC’s recent annual meeting Attorney Pepe presented, “Mountainside Treatment Center v. United Health Group, Inc. et al.” In this case, United Health Care and its subsidiary, Optum recouped significant portions of previous payments made to Mountainside for patient treatment by illegally withholding payment due to Mountainside services made to subsequent patients. The court has ruled, preliminarily, that Mountainside has legally valid assignments of both the right to receive payment and commensurate right to bring a claim under ERISA (Employee Retirement Income Security Act of 1974) for nonpayment and illegal recoupment.
