Trial Victory in Employment Discrimination Case
November 8, 2024Recently, one of the firm’s business clients won a trial victory in an employment discrimination case brought in Connecticut Superior Court.
On September 4, 2024, the court entered judgment in favor of client Road Ready Used Cars following a four-day trial. A former employee brought suit claiming that Road Ready terminated him in retaliation for filing a workers’ compensation claim, in violation of state anti-discrimination laws. The court ruled that the “more credible and weightier evidence” presented by Road Ready’s counsel disproved the former employee’s case. Specifically, counsel proved that Road Ready did not fire the former employee — he resigned. Moreover, Road Ready did not retaliate against the employee for filing a workers’ compensation claim — counsel proved that Road Ready accommodated his injury and helped him secure workers’ compensation benefits.
The trial was a battle of conflicting stories of what was said and done on Plaintiff’s final day of work. Road Ready’s counsel presented compelling eye-witness testimony from several witnesses. They also provided the Court with detailed evidence about Road Ready’s business practices and policies that fully supported its witnesses’ testimony and undermined the former employee’s version of events. Counsel’s meticulous trial preparation and comprehensive understanding of Road Ready’s business led to a compelling presentation at trial.
Road Ready was represented at trial by attorneys Rob Flynn and Mike O’Sullivan. Jim Brownstein managed Road Ready’s representation prior to the trial.
