The attorneys in the Commercial Finance & Banking Group provide comprehensive services to financial institutions and other varied entities. Clients are typically involved in extending secured and unsecured commercial loans as well as in working out and restructuring these loans.

Neubert, Pepe & Monteith represents regional and national lenders in structuring, negotiating, and documenting numerous types of financing transactions. These include commercial real estate loans, asset-based loans, construction loans, and commercial loans.
Neubert, Pepe & Monteith counsels clients a multitude of financial issues. These include collateral protection and perfection, multi-borrower transactions, multi-lender transactions and complex inter-creditor and multi-jurisdictional issues. Our group also represents financial institutions in preparing standardized loan documents. We work closely with our clients through the various stages of the lending process. The lending process entails the initial structuring phase, the commitment letter phase, document preparation and negotiation, and the closing of the transaction.

Our group has substantial experience in handling troubled debt matters, including workouts and restructures. We work with our clients on developing the best strategy to obtain satisfaction of the indebtedness. In particular, these may involve analysis of strengths and weaknesses of existing documentation, forbearance arrangements, obtaining additional collateral, and troubled debt restructures. Also, the sale of the loan, short sales of collateral, foreclosures, secured party sales, litigation, or bankruptcy. Additionally, we provide advice on such diverse matters as financing the purchase of assets from a bankruptcy estate and structuring and negotiating debtor-in-possession financing facilities.
